1. Overview

Mika Locals is a platform designed to help users discover local businesses and help businesses gain visibility. We do not guarantee outcomes, rankings, or business performance.

2. Eligibility

You must be at least 18 years old, or the age of legal majority where you live, to create an account or submit a business listing on Mika Locals. By using the platform, you confirm you meet this requirement.

3. Use of Platform

You agree to:

• Use the platform lawfully
• Not misuse or attempt to disrupt the system
• Not submit false or misleading information

4. Business Listings

We reserve the right to:

• Approve, reject, or remove listings
• Modify listing content for clarity or accuracy
• Determine how listings are displayed

Being listed on Mika Locals does not guarantee visibility, ranking, or customer acquisition.

5. Publicly Available Data & Privacy

Business information shown on Mika Locals (such as name, address, phone number, and other listing details) is drawn from publicly available sources or provided directly by businesses. We do not support or condone using the platform to invade anyone's privacy.

If you believe information about you or your business should not be publicly displayed, you may request its removal by contacting us. We treat every removal request as a high priority and act on it promptly. However, we are not liable for information that was publicly available prior to removal, or for how such information may have been used by third parties.

6. No Endorsement

We do not endorse or guarantee any business listed. Users are responsible for verifying services and making independent decisions.

7. Third-Party Websites & Links

Mika Locals may display or link to third-party websites, including business websites, social media profiles, and mapping services. We do not control and are not responsible for the content, accuracy, or practices of these third-party sites. Visiting a linked site is at your own risk and subject to that site's own terms.

8. No Guarantee of Availability

We may modify or discontinue features, restrict access, or update the platform at any time.

9. Limitation of Liability

To the fullest extent permitted by law, Mika Locals is not liable for business outcomes, user decisions, or losses arising from use of the platform. Use is at your own risk.

Nothing in these Terms excludes or limits our liability for:

• death or personal injury caused by our negligence;
• fraud or fraudulent misrepresentation; or
• any other liability that cannot be excluded or limited under applicable law.

Subject to the above, our total liability to you arising from these Terms or your use of the platform is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) AUD $100.

10. Intellectual Property

All platform content, branding, and systems are owned by Mika Locals. You may not copy, reproduce, or distribute without permission.

11. User Submissions

If you submit content (e.g. business details):

• You grant us a license to use, display, and modify it
• You confirm you have the right to share it

12. Termination

We may suspend or terminate access if Terms are violated or misuse is detected.

13. Changes to Terms

We may update these Terms at any time. Continued use of the platform constitutes acceptance of the updated Terms.

14. Your Statutory Consumer Rights

Nothing in these Terms is intended to exclude, restrict, or modify any consumer protection, guarantee, right, or remedy that applies to you under the law of your country or state of residence and cannot lawfully be excluded or limited — including, where applicable, rights under the UK Consumer Rights Act 2015, the UK Consumer Contracts Regulations 2013, the Australian Consumer Law, or equivalent legislation elsewhere. Where such mandatory rights apply, these Terms operate subject to them, and nothing in these Terms limits or excludes those rights.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of Australia, subject always to section 14 (Your Statutory Consumer Rights).

Before starting any formal legal proceeding, please contact us at contact@mikadigital.com.au so we can try to resolve the issue informally. Nothing in this section prevents you from bringing a claim in the courts of your own country where mandatory consumer protection law gives you that right.

16. Severability

If any provision of these Terms is found invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and Business Listing Terms, make up the entire agreement between you and Mika Locals regarding your use of the platform, and supersede any prior agreements on this subject.

18. Mika Sites Integration

Mika Locals offers an optional integration with Mika Sites — a separate website-building platform operated by Mika Digital. The following applies when you choose to use this feature:

• User-initiated only. The connection between Mika Locals and Mika Sites is triggered exclusively by you clicking “Build Website” in your dashboard. Claiming or updating a profile does not automatically create a Mika Sites website.
• Data transfer. When you initiate the connection, your Mika Locals profile data — including business name, contact details, logo, images, and location — is transferred to Mika Sites to provision your website.
• Bidirectional sync. After the connection is established, changes you make to your Mika Locals profile may be automatically reflected on your Mika Sites website. Conversely, certain updates made via your Mika Sites dashboard (such as contact details or logo) may sync back to your Mika Locals profile.
• Separate platform. Mika Sites is a separate service with its own terms, pricing, and data practices. By connecting your profile, you also agree to Mika Sites' Terms of Service.
• Disconnection. To disconnect your Mika Locals profile from Mika Sites, contact us at contact@mikadigital.com.au. Disconnecting stops future syncs but does not automatically delete your Mika Sites website.
